Arbitration – a flexible way to resolve disputes

Arbitration is an alternative to the ordinary courts and is often used to resolve disputes efficiently, discreetly, and with greater flexibility. At KROMANN Law Firm, we have extensive experience with arbitration cases and can guide you safely through the entire process.

What is arbitration?

Arbitration is a private legal process where the parties—rather than going to court—agree that one or more arbitrators will decide the case. Unlike the courts, arbitration is based on contractual freedom, which gives the parties significant influence over how the case is handled.

The parties can, among other things, decide:

  • who will act as arbitrators

  • how many arbitrators will participate

  • which procedural rules will apply

Arbitration is especially popular in business contexts—such as the construction industry—because cases are handled confidentially and typically more quickly than in the courts.

Advantages and disadvantages of arbitration

Advantages:

  • the parties can tailor the procedure themselves

  • the public and media do not have access

  • the parties appoint the arbitrator(s)

  • advantageous in international disputes

  • typically faster resolution time

Disadvantages:

  • no possibility of appeal

  • fewer procedural safeguards compared to court proceedings

  • limited contribution to legal development

  • concerns about equal treatment of parties

  • higher costs in smaller cases

If you are unsure whether arbitration is the right choice for your dispute, KROMANN Law Firm is ready to help. We will assess your case with you and determine whether arbitration is the appropriate solution.
