Adverse possession & easements

Are you in dispute with your neighbour about where the boundary line runs, whether you have acquired rights through adverse possession, or what rights you have to access roads? Then KROMANN Law Firm can advise you.

Boundary lines

In larger rural properties, disputes often arise about the exact location of property boundaries, which can be costly, especially if the land is used for cultivation. Misunderstandings about the boundary may mean that you effectively have less land to farm, and in the worst case it can affect the overall value of your property.

If there is uncertainty about the boundary line and neighbours cannot agree, the boundary can be formally determined through a so-called boundary survey (skelforretning). It is always advisable to have a lawyer guide you through this process, as it is often legally complex. At KROMANN Law Firm, we are ready to help you safely through a boundary survey and the related proceedings.

Adverse possession

Adverse possession refers to a situation where you may have acquired full or partial rights of use—or ownership—of another person’s property. It requires long-term, continuous, and unauthorised use where the original owner has not objected. Objections can be verbal or physical (e.g. barriers).

Adverse possession is highly dependent on the ability to prove your claim. There are several types of adverse possession that may be relevant when determining whether rights have been acquired. KROMANN Law Firm has extensive experience with such cases and can assist you throughout the process, including representation before the High Court and Supreme Court.

Road rights

There are many rules regarding roads, typically divided into different categories. A distinction is made between private common roads and private roads.

A private common road is open to public traffic and is linked to several properties along the road. Maintenance obligations lie with the landowners whose properties border and use the road, and costs are shared among them.

To establish clear rules for maintenance, it is often advisable to create a homeowners’ association or road association. KROMANN Law Firm can assist with setting up such associations.

A private road is typically a driveway or farm track that does not run across other properties. Maintenance is solely the responsibility of the owner. However, rights of way may exist, for example where a farmer is allowed to use a field road or where a neighbour must cross another property to access their own land.

Disputes about road rights are common between neighbours, and legal assistance is recommended. Our lawyers can help clarify your rights and communicate with the other party, always aiming for a constructive solution. If necessary, we also represent clients in court, including High Court and Supreme Court cases.
