Debt collection and recovery

How do you get money back that you are owed? If you are dealing with a problematic debtor, our lawyers can assist with your case and work to ensure you recover your claim.
DEBT COLLECTION
If you have an unpaid invoice or other outstanding claim that you wish to recover, you must comply with a number of debt collection rules, including “good debt collection practice”. In many cases, you must also bring your case before the enforcement court (fogedretten) for recovery. KROMANN Law Firm’s lawyers have extensive experience in all aspects of debt recovery and assist with everything from initial communication with the debtor to proceedings in the enforcement court. We know the rules and the best ways to recover your claim, so you can safely leave your case with us.
INSTALLMENT plan AGREEMENTS
If you have a claim but are faced with a debtor who cannot pay, you may consider entering into an installment agreement. This allows you to reach an amicable agreement with the debtor to repay the debt in ongoing installments, which is less burdensome for the debtor. KROMANN Law Firm can assist in drafting an installment agreement tailored to your needs.
PAYMENT CLAIMS AND ENFORCEMENT COURT HEARINGS
In many cases, it can be beneficial to submit a payment claim to the enforcement court. A payment claim is a document submitted by a creditor to initiate a simplified debt collection process, which among other things interrupts limitation periods so you do not lose your claim.
A payment claim is often followed by a hearing in the enforcement court, where the debtor is summoned to assess payment options. If the debtor cannot pay, options such as seizure of assets will be considered. KROMANN Law Firm can assist with preparing the payment claim and representation at court hearings.
SEIZURE OF ASSETS
As a creditor, you may be entitled to seize the debtor’s assets. This requires that the case has been through the enforcement court and that the debtor has assets that can be seized.
KROMANN Law Firm assists in assessing your options for asset seizure. Note that certain items are exempt under legal “necessary assets” rules and cannot be seized.
AUCTIONS
If you have obtained a lien or seizure of assets and the debtor does not pay, it may be possible to initiate an auction to recover your claim.
