The process in enforcement cases

In order for the authorities to assist you in enforcing contact, you must have either a court decision or a written agreement on contact that includes an enforceability clause, stating the specific days and times when contact is to take place.

When enforcement proceedings are initiated, the court will first attempt to reach an agreement between the parties regarding contact. If this is not successful, the court may order enforcement of the contact arrangement. In special situations, the court may decide that the child must be collected with police assistance. However, the family court will most often seek the least intrusive solution for the child.

In some cases, the court may decide that contact should not be enforced, and that the child therefore should not be handed over. If it is assessed that enforcement is not in the child’s best interests, the family court may refuse to enforce the contact arrangement.
