Extended Cohabitation Will

When you are cohabiting, you do not automatically inherit from each other, regardless of how long you have lived together. If you do not wish to get married, it is therefore important to make a will, so that you do not risk losing your home when one of you passes away.
If you have been cohabiting for more than 2 years, or if you have/are expecting children together, you can make an extended cohabitation will. This will in some respects place you in a position similar to that of married couples in terms of inheritance. However, even if you make an extended cohabitation will, you will still have to pay 15% inheritance tax. You also cannot, through a will, obtain a right for the surviving partner to remain in undivided possession of the estate.
A will should always be prepared based on the individual situation. If you wish to make a will, it is therefore important to contact a qualified lawyer who can advise you on your options.
