Family reunification

Under the rules on family reunification, you as a Danish citizen, or as a foreign national residing in Denmark, may be reunited with your family. The rules on family reunification apply if your spouse, cohabiting partner, or children reside outside the EU. If your family members reside within the EU, it is generally not necessary to apply for family reunification, as EU citizens have free movement within the EU borders.

In order to obtain family reunification, a number of conditions must be met. It is also possible to apply for family reunification under both Danish rules and EU rules.

FAMILY REUNIFICATION UNDER DANISH LAW

The conditions for applying for family reunification change frequently. The requirements depend, among other things, on whether the person residing in Denmark is a refugee or a Danish citizen, and whether the application concerns a spouse/partner or a child.

Both the family member applying for residence and the family member residing in Denmark must meet a number of requirements. These include requirements relating to financial circumstances, language skills, and age.

FAMILY REUNIFICATION UNDER EU RULES

If you do not meet the conditions for family reunification under Danish rules, it may in some cases be possible to apply for family reunification under EU rules instead.

EU rules differ from Danish rules in many aspects. In order to obtain family reunification under EU rules, the following conditions must generally be met:

• The Danish family member must have exercised their right to freedom of movement within the EU,

• The Danish family member must have established a genuine and actual residence in another EU country,

• The applicant may have resided in the other EU country together with the Danish family member, and

• There must be a temporal connection between the residence in the other EU country and the application for family reunification.
