Fatherhood
If you are involved in a fatherhood dispute, KROMANN Law Firm can advise you on your options and the legal process. We have handled many Fatherhood cases before the Agency of Family Law (Familieretshuset) and the family courts, and we therefore have extensive experience in this area. We can assist both those who wish to be registered as the father of a child, and those who are expecting a child and are facing a fatherhood case. In addition, we also have experience with the reopening of fatherhood cases.

WHO IS REGISTERED AS THE CHILD’S FATHER?
In Danish law, legal parenthood is generally based on biological parenthood.
When a man is registered as the child’s legal father, this entails a number of rights and obligations, including parental custody rights, contact rights, inheritance rights, and a duty of financial support. These rights and obligations do not automatically apply to the biological father if he is not registered as the child’s legal father.
When a child is born to a married woman, her husband is generally automatically registered as the father of the child. However, the situation is different if a child is born to an unmarried woman.
In order to be recognised as the father of a child born to an unmarried woman, the father and the mother must sign a declaration of care and responsibility together. It is also possible to acknowledge Fatherhood by submitting a declaration to the Danish Family Court (Familieretshuset).
DISPUTE REGARDING PATERNITY
If there is disagreement regarding fatherhood, the Agency of Family Law (Familieretshuset) will automatically initiate a fatherhood case in connection with the child’s birth. If, contrary to expectations, a case is not initiated automatically, it is possible to apply to the Agency of Family Law to start a fatherhood case. In such cases, the child’s mother must provide information about who may be the father.
The Agency of Family Law may either decide the case itself or refer it to the family court. KROMANN Law Firm can assist you in any fatherhood case before the Agerncy of Family Law or the family courts, as well as help you apply for the initiation of a fatherhood case.
We are also specialists in parental responsibility, residence, and contact arrangements, and we can therefore assist you further in matters concerning your child once fatherhood has been established.
IF A FATHER HAS ALREADY BEEN REGISTERED
If a father has already been registered for the child and you wish to change this, you must apply for a reopening of the fatherhood case. You can read more about this on the page below.
