Forced removal of children

KROMANN Law Firm has more than 20 years of experience in cases involving the involuntary placement of children.

FREE LEGAL ASSISTANCE

As a parent, you always have the right to be appointed a lawyer in cases concerning the removal of a child from the home. This applies both during proceedings before the Children and Youth Committee (Børne- og Ungeudvalget), appeals to the National Social Appeals Board (Ankestyrelsen), and any subsequent court proceedings. Legal assistance is free of charge, and you may choose your own lawyer.

If the child is 10 years old or older, the child also has the right to their own lawyer. At KROMANN Law Firm, we assist both parents and children in these cases to ensure that all parties receive the best possible legal support.

CHOOSING THE RIGHT LAWYER IN CHILD REMOVAL CASES

When a municipality considers removing a child from the home, it is one of the most serious interventions the authorities can take against a family. The decision may have lifelong consequences for both the child and the parents. It is therefore crucial that your rights are safeguarded by an experienced lawyer.

At KROMANN Law Firm, we have more than 20 years of experience in child removal cases. We advise and represent parents and children throughout Denmark—from the initial contact with the municipality to proceedings before the Children and Youth Committee, the National Social Appeals Board, and the courts. We have rights of audience before the District Court, High Court, and Supreme Court and can take your case all the way if necessary.

We work in a focused, thorough, and committed manner to ensure a fair handling of your case.

WHAT IS CHILD REMOVAL?

Child removal—also known as involuntary placement—means that the municipality decides to place a child outside the home without the parents’ consent. This may only happen if the child is considered to be in serious danger and if less intrusive measures are not sufficient.

The municipality must prepare a child welfare investigation and present the case to the Children and Youth Committee if there is no parental consent. You have the right to legal assistance throughout the process.

WHEN SHOULD YOU CONTACT US?

The earlier we are involved, the better we can assist you. You should seek legal advice if you:

  • Receive reports from school, daycare, or healthcare authorities
  • Are informed about a child welfare investigation
  • Are told that the municipality is considering placing your child outside the home

We can attend meetings, review documents, and ensure that your perspective is included in the case.

WHAT WE DO AS YOUR LAWYER

Our role is to ensure that the case is handled correctly and that your rights are respected. We act as your legal representative and work solely in your interest. This means that we:

  • Review all case documents and assess the legality of the municipality’s actions
  • Prepare you for hearings before the Children and Youth Committee and the Appeals Board
  • Draft submissions and present your arguments clearly
  • Identify procedural errors or legal issues
  • Conduct court proceedings if necessary

We work systematically to build a strong case and ensure that decisions are made on a correct legal basis.

HOW THE CASE IS HANDLED

If the municipality does not obtain consent for placement, the case is referred to the Children and Youth Committee. The committee consists of a judge, two child welfare experts, and two local politicians. As a parent, you have the right to attend the hearing together with your lawyer.

The municipality must provide access to all relevant documents in advance. We ensure that you are prepared and that your case is properly presented.

If you disagree with the committee’s decision, we can appeal to the National Social Appeals Board. If you also disagree with that decision, we can bring the case before the courts.

COMMON ERRORS WE IDENTIFY

Many child removal cases contain errors that can be decisive. We often see that:

  • Parents have not been sufficiently involved in the investigation
  • Less intrusive measures were not attempted
  • Decisions are based on outdated information
  • Assessments are one-sided and not balanced

We document these errors and use them actively in our legal arguments.

CAN CHILD REMOVAL BE AVOIDED?

Yes, in many cases it can be avoided if the case is handled correctly from the start. This may include showing that the child is thriving, that concerns are unfounded, or that the parent can cooperate on necessary changes.

We also advise on alternatives such as support persons, respite care, or other forms of assistance.

CONTACT WITH THE CHILD DURING PLACEMENT

If your child is placed outside the home, you generally still have the right to contact. The municipality determines the extent and form of contact. We help ensure that contact is appropriate and in the best interests of the child.

We also handle cases involving supervised contact and restrictions on communication.

SPECIAL CASES – INFANTS AND ADOPTION WITHOUT CONSENT

Cases involving infants require special attention due to the speed at which authorities act. We have experience in cases involving immediate placement after birth and forced adoption. These cases require urgent action.

We ensure that deadlines are met and that your rights as a parent are protected.
