Inheritance Law

Are you in an inheritance dispute, or do you wish to prevent one? Inheritance cases are often emotional and complex – both legally and personally. Disagreements about wills, undivided estates, or the distribution of inheritance can quickly develop into serious conflicts that in some cases end up in court.

At KROMANN Law Firm, we have some of the country’s leading lawyers in family and inheritance law. We specialise in inheritance law and have more than 20 years of experience conducting inheritance cases before Danish courts. We advise and assist you throughout the entire process – from prevention and mediation to litigation if necessary.

We always work towards the best possible solution – whether through dialogue, court mediation, or a court ruling. Our goal is to create clarity, avoid unnecessary conflicts, and protect your rights through a professional and human approach.

Mediation as a beneficial way of resolving conflicts

In inheritance cases, even small disagreements can develop into deep conflicts – especially when emotions and family relationships are involved. At KROMANN Law Firm, we offer mediation as an effective and dignified alternative to court proceedings.

What is mediation?

Mediation is a structured process in which a neutral and impartial third party – typically a lawyer certified as a mediator – helps the parties reach a common solution through dialogue and negotiation. The aim is to create an agreement that both parties can accept without the involvement of the courts.

The advantages of mediation include:

  • The conflict is resolved faster and more cost-effectively than through court proceedings
  • The parties retain greater control over the outcome
  • Relationships between heirs can often be preserved, and mediation can both prevent and resolve inheritance disputes

When can mediation be used?

Mediation can be used both before a conflict escalates – for example in connection with the distribution of an estate – and after a dispute has already arisen. Many inheritance disputes are not only about legal issues, but also about misunderstandings, emotions, and long-standing disagreements. In such cases, mediation can be an effective tool for finding a solution that takes both legal and human aspects into account.

At KROMANN Law Firm, we have extensive experience with mediation in family and inheritance law cases and are happy to assist you – either as mediators or as your legal adviser in a mediation process.

When do inheritance disputes end up in court?

If it is not possible to reach a solution through dialogue or mediation, a court case may be the last resort. However, this is a solution that is both time-consuming and costly – and rarely desirable if other options are available.

Inheritance disputes typically arise when:

  • The heirs cannot agree on the distribution of the estate
  • There is disagreement about the validity or interpretation of a will
  • An heir believes there has been misuse of an undivided estate
  • There is suspicion of favouritism, unequal treatment, or hidden assets

How can we help?

At KROMANN Law Firm, we offer specialised advice and conduct litigation concerning, among other things:

  • Misuse of an undivided estate
  • Interpretation or invalidation of a will
  • Invalidity of a will (e.g. due to fraud, coercion, or formal defects)
  • Estate distribution and disputes between heirs
  • Unequal distribution in blended families

We ensure that the lawyer who knows your case also handles it in court, providing you with consistent and qualified case management from start to finish.

Practical information about court proceedings

An inheritance case in court typically takes 1–2 years. If the case is appealed, the process may be extended by up to one additional year. It is a complex process, but you will not face it alone.

At KROMANN Law Firm, we assist you with:

  • Collecting and organising relevant documentation
  • Drafting and managing correspondence with the opposing party
  • Assessing the need for expert opinions (e.g. court-appointed experts or medical reports)
  • Preparing and representing you at the oral hearing
  • Advising on appeal options and the financial consequences

We guide you safely through the entire process – with focus on both your legal rights and your personal needs.

What does a lawyer for an inheritance case cost?

It can be financially burdensome to conduct a court case, but in some situations it is possible to have a large part of the costs covered. If you meet the financial requirements, your legal fees, court fees, and other expenses may be covered while we handle your case.

This may be possible through:

  • Your legal expenses insurance, which is often included in home contents insurance
  • Legal aid (free legal aid), granted by the Danish Civil Affairs Agency (Civilstyrelsen)
  • The court’s decision in certain cases

At KROMANN Law Firm, we help you assess whether you are eligible for financial support, and we prepare all necessary applications in connection with your case. If you do not meet the requirements, you must cover the costs of the case yourself.
