Mutual Will

Fælles testamente

A mutual will is used if you are married and wish to jointly decide how your estate is to be distributed after your deaths.

If you are married, have community property, and have children, issues may arise when one of you passes away. This is because the surviving spouse and the deceased spouse's children will generally inherit the estate together, with one half passing to the surviving spouse and the other half to the children. This may result in the surviving spouse having to sell the family home or other assets in order to pay the children's inheritance.

A mutual will is therefore often used to ensure that the surviving spouse inherits as much as possible from the spouse who dies first. The will can provide that the children receive only their compulsory share of the inheritance upon the first death and receive the remainder only after the surviving spouse has passed away. The will can also be used to benefit a child, grandchild, or another beneficiary.

The above is merely an example of what a mutual will may contain. The will can be tailored to meet your specific wishes, which is why it is important to obtain qualified legal advice when preparing it. When you make a will with the assistance of KROMANN Law Firm, you can be confident that you will receive a legally valid will that achieves its intended purpose.

DO YOU WISH TO PROVIDE FOR YOUR SPOUSE AS MUCH AS POSSIBLE?

If you wish either your children or your spouse to inherit as much as possible from your estate, it is possible to combine a will with a marital agreement.

For example, if you have children and wish the surviving spouse to inherit as much as possible, a marital agreement combined with a will can ensure that the majority of the estate of the spouse who dies first passes to the surviving spouse. Conversely, it is also possible to ensure that your spouse inherits as little as possible, allowing the estate to pass immediately to your children or other chosen beneficiaries.

At KROMANN Law Firm, we specialise in family and inheritance law and have more than 20 years of experience. We have therefore prepared countless marital agreements and wills. This enables us to combine a marital agreement and a will to provide a comprehensive solution tailored to your specific wishes.
