Paid sick leave

As a general rule, only salaried employees are entitled to paid sick leave. However, many collective bargaining agreements provide that employees are entitled to full or partial pay during sickness for a certain period.

If an employee is not covered by the Danish Salaried Employees Act, they are generally not entitled to salary during sickness. However, if the employee meets the employment requirements under the Danish Sickness Benefits Act, they are entitled to sickness benefits paid by the employer during the first 30 days of absence. After that period, the employee will receive sickness benefits from the municipality.

Where the employee receives salary during sickness, the employer may, provided the employee meets the requirements under the Danish Sickness Benefits Act, claim reimbursement of sickness benefits after the first 30 days of sick leave.

Is your sickness the result of an accident?

If your sick leave is caused by an accident, your employer may, in many cases, be entitled to recover the additional costs arising from your absence from the person responsible for the accident. This is known as employer recourse, and the compensation is typically paid by the liable party's insurance company.

If you are on sick leave following an accident, you should inform your employer about the possibility of compensation as soon as possible.
