Patient injury

If you have been exposed to medical malpractice or treatment that has resulted in unreasonable consequential harm, you may be entitled to compensation. Compensation is assessed under the Danish Liability for Damages Act (Erstatningsansvarsloven), which also applies to injuries caused by medication.

Patient injury cases must be reported to the Danish Patient Compensation Association (Patienterstatningen). A decision from Danish Patient Compensation Association can be appealed to the Patient Injury Appeals Board (Patientskadeankenævnet), and the decisions of this appeals board can be reviewed by the courts.

The patient insurance scheme covers both public hospitals, private hospitals, and private clinics. All treatments provided by doctors and other licensed healthcare professionals are covered by this special scheme.

Cases involving patient injuries and pharmaceutical injuries are complex and require insight into both medical and legal issues. The calculation of compensation can be particularly difficult, and if you are granted compensation for a patient injury, an appeal to the appeals board always carries the risk of losing all or part of your compensation.
