Rental inspections

KROMANN Law Firm has extensive experience in tenancy law and can therefore assist both tenants and landlords in disputes relating to rental properties.
In connection with moving into a rental property, a landlord who lets more than one residential unit is obliged to carry out a move-in inspection. However, KROMANN Law Firm strongly recommends that a move-in inspection is always carried out at the start of a tenancy, as this is generally beneficial for both tenant and landlord.
IF YOU ARE A TENANT
As a tenant, it is beneficial to take part in a move-in inspection, as this helps ensure that you will not be held liable for any defects or wear and tear that were already present at the time of moving in. You should also be aware that if the landlord is legally required to carry out a move-in inspection and fails to do so, the landlord may generally be unable to claim costs for reinstatement or refurbishment when you move out.
As a tenant, you should also note that you may report any defects or issues to your landlord up to 14 days after the start of the tenancy. After this 14-day period, the right to claim defects may be lost, which makes it important to report any issues promptly after moving in.
Even when inspection reports are prepared, disagreements and disputes may still arise both at move-in and move-out. At KROMANN Law Firm, we provide legal assistance in connection with move-in and move-out inspections to ensure that everything is carried out correctly in accordance with tenancy law.

IF YOU ARE A LANDLORD
As a landlord, you have a number of obligations and rights in connection with tenant move-in and move-out processes. If you rent out more than one residential unit, you are required under the Tenancy Act to carry out both a move-in inspection and a move-out inspection.
If this obligation is not fulfilled, you will generally not be able to claim costs for restoration or refurbishment when the tenant moves out. However, it may still be possible to bring a claim for damages if the tenant has caused damage or otherwise breached their obligations.
As part of the move-in inspection requirement, you are also obliged to prepare a move-in report, in which the parties record the condition of the property at the time of move-in, including any defects for which the tenant will not be held responsible at move-out. There are strict requirements regarding both the content and delivery of the report to the tenant. Failure to comply with these requirements may result in the loss of the right to bring claims against the tenant, making it essential to ensure compliance with tenancy law.
At the time of the tenant’s move-out, a move-out report must also be prepared, specifying which parts of the property require restoration. As a general rule, the move-out report must be signed by both tenant and landlord.
The move-in and move-out reports determine the extent to which the landlord may require the tenant to cover refurbishment costs. After the restoration work is completed, a final settlement statement must be prepared, including costs for repairs as well as any rent arrears. Strict rules and deadlines apply to this statement, and failure to comply may result in the loss of the landlord’s claim against the tenant.
Tenancy law rules regarding move-in and move-out procedures can be complex. At KROMANN Law Firm, we are ready to advise you on all aspects of letting property. We can assist with the preparation of inspection reports and settlement statements, and represent you before the Rent Tribunal or Housing Court in case of disputes with tenants.
