TRAFFIC ACCIDENT INJURY – GET THE COMPENSATION YOU ARE ENTITLED TO

Have you been injured in a traffic accident – as a driver, passenger, or pedestrian – you may be entitled to compensation.

At KROMANN Law Firm, we have extensive experience with personal injury cases and guide you safely through the entire process. We ensure that your rights are protected and that you receive the compensation you are entitled to.

WHAT ARE YOU ENTITLED TO?

In connection with a traffic accident, you may be entitled to one or more types of compensation, depending on the nature of the injury and the circumstances of the accident. The most common claims include:

Loss of earnings

If you are temporarily unable to work due to the injury, you are entitled to compensation for your financial loss until you are fit to return to work. This covers the income you would have earned during the period.

Loss of earning capacity

If your ability to work is permanently reduced by at least 15%, you may be entitled to compensation for loss of earning capacity. This also applies if you are a student, homemaker, or outside the labour market.

Pain and suffering

For temporary injuries, you may receive a daily allowance for the period you are sick or in treatment. The rate is set by law and adjusted annually.

Permanent injury compensation

If you suffer permanent physical or psychological consequences, you may be entitled to compensation for permanent impairment. The impairment degree is assessed according to the Danish Labour Market Insurance Authority’s (AES) guidelines and is generally required to be at least 5%.

Medical expenses and other costs

You may have covered reasonable and necessary expenses for treatment such as doctors, physiotherapy, or specialists. You may also receive compensation for transport, medication, and other documented expenses.

Loss of provider and compensation for grief

In cases of death following a traffic accident, surviving relatives may be entitled to compensation for loss of provider and compensation for grief. This typically applies to spouses, partners, children, and parents.

IS THERE A LIABLE PARTY?

Your compensation options depend on who caused the accident and how it occurred. Typical situations include:

  • Accident with a responsible party: You can claim compensation through the liability insurer of the opposing party.

  • Unknown driver or uninsured party: Compensation may be claimed through DFIM (Danish Motor Insurers Bureau).

  • Single-vehicle accident: You may claim through your own insurance, such as accident insurance or driver cover.

  • Accident during work: In addition to other claims, the injury must be reported to your employer’s workers’ compensation insurance.

WHAT SHOULD YOU DO?

To obtain compensation, documentation of your injuries and symptoms is essential. We recommend:

  • Seek medical attention as soon as possible – ideally within 72 hours

  • Continuously document your symptoms, including delayed (“bridge”) symptoms

  • Report the injury to the relevant insurance companies

  • Contact a lawyer – preferably early in the process

Documentation is crucial to prove both the injury and the causal link between the accident and your symptoms.

HOW WE HELP YOU

A typical process with us looks like this:

  • You contact us and we review your situation

  • We advise you on your rights and options

  • We collect and assess relevant documentation

  • We handle communication and negotiations with insurance companies

  • We ensure that you receive the compensation you are entitled to

We know how challenging it can be to go through an injury process. That is why we handle the legal side – so you can focus on your recovery.

WHAT DOES A LAWYER COST IN TRAFFIC ACCIDENT CASES?

Many people hesitate to contact a lawyer due to cost concerns – but in traffic accident cases, this is usually not necessary.

In personal injury cases, the liable party’s insurance company will typically cover all or part of your legal costs. This means you will rarely have to pay the full amount yourself. We clarify early in the process what costs (if any) you should expect.
