Workplace injury

A workplace injury can have major consequences for your daily life and your finances. When you are affected by an accident at work, it is important to understand your rights and the options you have to claim compensation.

At KROMANN Law Firm, we have extensive experience assisting people who have suffered workplace accidents or developed occupational diseases.

We ensure that you receive the best possible compensation, and we guide you through the entire process so you are not left alone with your case.

WHAT IS A WORKPLACE INJURY?

A workplace injury covers two types of injuries:

  • An occupational accident: A physical or psychological injury that occurs suddenly during work, for example a fall, a machine-related accident, or an incident of violence.

  • An occupational disease: An illness that develops over time as a result of working conditions, for example hearing loss from noise, lung diseases caused by chemicals, or psychological strain.

Both occupational accidents and occupational diseases may entitle you to compensation, but the rules and procedures vary depending on the type and cause of the injury.

WHAT COMPENSATION CAN YOU RECEIVE FOR A WORKPLACE INJURY?

Once your workplace injury has been recognised, you may be entitled to different types of compensation:

  • Compensation for permanent injury
If your injury has caused permanent physical or psychological impairment, you may receive compensation for permanent injury. The amount depends on the severity of the injury and is determined according to a standardized medical impairment table.
  • Loss of earning capacity compensation
If the injury has affected your ability to work, you may be entitled to compensation for loss of earning capacity. This applies if you are no longer able to work at the same level as before the injury. The compensation is based on how much your income has been reduced.
  • Loss of earnings
If your injury has prevented you from working for a longer period, you may be compensated for lost income. This applies until your working capacity has been assessed and any loss of earning capacity compensation can be determined.
  • Pain and suffering compensation
In cases of acute illness or prolonged recovery periods, you may receive compensation for pain and suffering. This covers the inconvenience experienced while you are on sick leave.
  • Medical expenses
Costs for doctors, physiotherapy, medication, and other necessary treatments may be covered if they are required for your recovery or rehabilitation.
  • Survivor’s compensation
If a workplace injury results in death, surviving relatives may be entitled to compensation for loss of a provider.

WHO PAYS YOUR COMPENSATION?

When you have suffered a workplace injury, there are two main sources of compensation:

  • Occupational injury insurance: All employers are required to have workers’ compensation insurance, which covers injuries regardless of who is at fault for the accident.

  • Employer liability insurance: If the employer has failed to comply with safety regulations, there may be grounds for a compensation claim against the employer.

At KROMANN Law Firm, we always assess whether you may be entitled to additional compensation beyond the standard coverage provided by the occupational injury insurance.

WHEN MUST YOU REPORT A WORKPLACE INJURY?

To secure your right to compensation, it is important that the injury is reported within the required deadlines:

  • Workplace accidents must be reported no later than one year after the injury occurs.

  • Occupational diseases must be reported no later than one year after you become aware that your illness may be work-related.

Your employer is obligated to report the injury, but we always recommend that you follow up to ensure the report is made correctly.

HOW DOES A LAWYER HELP YOU IN A WORKPLACE INJURY CASE?

A workplace injury case can be complex, and it can be difficult to understand what you are entitled to. At KROMANN Law Firm, we help you to:

  • Ensure correct reporting of the injury

  • Document the extent and consequences of the injury

  • Negotiate with insurance companies and authorities

  • Secure the highest possible compensation

We make sure your case is handled thoroughly and fairly, so you receive the compensation you are entitled to.

THE EMPLOYER’S RESPONSIBILITY

Employers are obligated to ensure a safe working environment. If they fail to meet this obligation, they may be held liable for a workplace injury. This may be the case if:

  • Safety measures are not followed

  • Work tasks are not properly organised

  • Machines and equipment are not properly maintained

  • The employer has failed to provide adequate training

If your employer can be held liable, you may be entitled to a higher level of compensation than the standard workers’ compensation insurance provides.

DOCUMENTATION IS CRUCIAL FOR YOUR CASE

In order to obtain compensation, it is important to document the injury and its consequences. We recommend that you:

  • Have the injury recorded by a doctor

  • Secure witness statements from colleagues

  • Keep all relevant work-related documents

  • Continuously document your health condition

Thorough documentation increases the chances of a successful case and the highest possible compensation.

SPECIAL RULES FOR SELF-EMPLOYED PERSONS

As a self-employed person, you are not automatically covered by workers’ compensation insurance unless you have a voluntary occupational injury insurance.

At KROMANN Law Firm, we advise self-employed individuals on their compensation options and ensure that you are not overlooked by the system.

NEGOTIATION WITH INSURANCE COMPANIES

Insurance companies have a financial interest in minimizing their payouts, which can result in rejection of your claim or offers of compensation that are lower than what you are actually entitled to.

At KROMANN Law Firm, we negotiate directly with insurance companies on your behalf.

We have many years of experience handling workplace injury cases and ensure that you receive proper guidance throughout the entire process.
