Division of assets
WHAT YOU SHOULD KNOW
A division of assets in connection with divorce is often complex and difficult to handle without a lawyer, and many people understandably fear an unfair division. In connection with the division, you should consider, among other things:
- Which assets and liabilities each of you owns
- Whether any assets should be exempt from division, such as separate property, personal assistance items, pensions, etc.
- Whether one party should buy out the other from a shared property, or whether it should be sold
- Whether you have joint debt and how it should be distributed going forward
- Whether adjustment and/or compensation claims should be made
The above are just examples of the many issues that must be considered in a division of assets. At KROMANN Law Firm, we can help you gain an overview and advise you on your rights and claims in connection with the division. We help you clarify the terms of your divorce and the division agreement.

A division of assets can be difficult to manage, and it is therefore essential to have proper legal assistance when negotiating with your former spouse about how your finances should be divided.

Our skilled divorce lawyers are happy to cooperate to find good and constructive solutions in difficult situations, but we will of course never compromise your interests. ARE YOU IN AGREEMENT ON THE DIVISION OF ASSETS?
Many people underestimate the importance of a written settlement agreement, and therefore only seek legal assistance once disputes arise. Regardless of whether you agree on the division, a written agreement should always be prepared in connection with divorce or separation, as it may be important to document that a division has taken place—for example in relation to financial institutions, inheritance, debt enforcement, and more. A written agreement also helps prevent future disputes.
If you need assistance drafting a settlement agreement, you can contact KROMANN Law Firm at +45 8618 1102 or email kontakt@advokatkromann.dk. We will help you move forward quickly and ensure the best possible division of your estate.
Please note that we can only represent both parties if you agree on how the estate should be divided. If there is disagreement, each party must obtain their own lawyer, and we can therefore only represent one party in the division.
IF YOU CANNOT REACH AGREEMENT
If you disagree on the division, a lawyer can assist in negotiations between the parties.
Many mistakenly believe that involving lawyers will make the process more complicated. However, this is not the case, and we often find that conflict levels actually decrease when lawyers are involved. The process becomes more structured, and disputes are typically limited to the actual areas of disagreement.
Lawyers can negotiate on behalf of the parties and ensure that discussions remain professional and focused. In many cases, it is therefore possible to reach a constructive solution without involving the probate court (skifteretten).
In some situations, however, the parties are unable to reach an agreement. If that happens, the probate court can assist. The court will initially hold a meeting with both parties to review assets and liabilities and attempt to facilitate a settlement. If no agreement is reached, a court-appointed estate administrator may be assigned to handle the division.
Regardless of where you are in the process, it is beneficial to have an experienced lawyer by your side to negotiate and protect your interests. Early legal assistance can often prevent the case from going to court and save both time and court-related costs.
